Is it possible to dispense with any insurance contract after a solicitation?

If you are an individual, it is possible to waive any insurance contract that you signed for non-business (home, auto, school, Warranty accidents of life …).

Some contracts are not affected by this possibility. These are:

  • of life insurance and capitalization for which the subscribers have a right of cancellation 30 days whether or not selling;
  • insurance contracts or travel bag for whatever duration;
  • insurance contracts for a maximum of one month.


I would give up an insurance contract that I was sold after a solicitation. What steps should I do?

Since 1 July 2008, you have the right to cancel your contract without penalty and without giving reasons for your request within 14 calendar days of age after the conclusion of the contract – unless you are asking for compensation of a claim occurred in this period.
To do this, you must send your insurer by registered mail with return receipt requested, a waiver letter in the format that was provided in the application for insurance or your contract. The cancellation becomes effective on the date of receipt by the insurer of your letter. Reimbursement by the insurer’s pro rata premium for the period not covered by warranty because of the waiver must be made within 30 days of receipt of your letter. After this period, the amount the insurer you should be with interest at the legal rate.

The phone call from an insurer wishing to sell me an insurance contract can be considered a solicitation?

Yes, because the solicitation does not necessarily imply the physical presence of the seller’s home or workplace of the person canvassed. It may as well be a phone contact or a mailing.
Several situations are considered the solicitation: you are contacted for a contract to be entered into your home, your office or from an insurer, you received a leaflet in your name in your mailbox asking you to move from an insurer to sign a contract, signing the contract with the insurer takes place at home or at your workplace, even at your request.

I purchased an insurance policy after being approached. If a loss occurs during the withdrawal period of 14 days, my insurer will he support?

Yes. The right of renunciation you receive does not affect the immediate effect the warranty.
To the extent that the insurer is then required to compensate you, you will not be possible to exercise your right of cancellation.
Note also that if after giving up your contract, you discover that a loss occurred before the waiver, the insurer will indemnify you and you will be required to pay the entire premium.
